D-7 Visa: Intra-Company Transferee

D-7 visa is for you, if you are a foreign employee of a branch or liaison office of a foreign parent company who is being transferred to Korea by the foreign parent company.

Eligibility

You are eligible for a D-7 visa if:

  • you have worked at the headquarters office, branch office or local office of a foreign public institution, organization or company for at least 1 year; and is going to be transferred to the affiliate, subsidiary, branch office or local office situated in the Republic of Korea as an ‘indispensable professional specialist’. Or
  • you are a foreign worker who has worked at an overseas branch office of a listed Korean corporation (including listed corporations in KOSDAQ) or of a public Korean organization for at least one year, and you are dispatched to the headquarters or main office in Korea to provide or receive on-the-job training for a set of professional skills/techniques/knowledge.

Visa Issuance Confirmation

Eligibility

You are eligible to apply for a visa issuance confirmation if:

  • A foreigner working at a Korean branch office of a foreign company
  • A foreign worker stationed at the domestic headquarters of a Korean company which has advanced into an overseas market
  • An eligible candidate as set forth in the Agreement between the Government of the Republic of Korea and the Government of the Russian Federation on Temporary Labor Activities of Citizens one state in the territory of other state
  • An eligible candidate as set forth in the Agreement between the Government of the Republic of Korea and the Government of the Republic of Uzbekistan on Temporary Labor Activities of Nationals of One State in the Territory of the Other State
  • An eligible candidate for agreement on Simplifying Visa Procedure between the Government of the Republic of Korea and the Government of the Republic of India
  • A person dispatched to a foreign legal consultant office or a foreign legal consultant
  • An office workers dispatched to a foreign legal consultant office

Documents Required

  • Visa Application Form
  • Passport
  • One standard-size photograph
  • Fee
  • A proof of your current employment status from the foreign company
  • A document demonstrating your overseas assignment (i.e. dispatch order: it should indicate the period of the overseas assignment)
  • A document demonstrating the establishment of the branch office in Korea (A copy of permission for the establishment of the Korean branch/contact office)
  • A document demonstrating that the branch/contact office is in proper operation (i.e. an induction of management capitals (business outline, tax payment records*, etc. for a newly established branch/contact office) (If you work for a non-profit organization that does not bear tax payment obligations, you can instead submit a document demonstrating the induction of management capitals in the Korean office.)
  • A document demonstrating that you are an indispensable professional specialist (i.e. resume, certificate of work experience, etc.)

Additional Documents

The confirmation of visa issuance number is issued by the head of an immigration (branch) office. The head of the immigration (branch) office may ask for additional documents depending on individual circumstances. Additional documents may include:

  • Comprehensive business registration of the headquarters (if it is a public company, you do not need to submit the document)
  • Foreign Direct Investment Declaration or Overseas Branch Office Establishment Declaration
  • A document proving the wire transfer to a foreign country
  • A certificate of business registration or a certificate of the registration of incorporation of the overseas branch office

The head of the diplomatic mission or the Korean Immigration office may ask additional documents to examine and verify the purpose of entry, genuineness of the invitation etc.

A single-entry or a multiple-entry visa will be issued to eligible applicants who meet all the required criteria.

  • A multiple-entry visa valid for two years will be issued to a Chinese worker stationed in the Republic of Korea (employed by a private/public company for at least one year)
  • A single/multiple-entry visa valid for one year or less will be issued to a foreign worker stationed at the domestic headquarters of a Korean company which has advanced into an overseas market.
  • A single-entry visa valid for one year, will be issued to a citizen of Chile in accordance with the Free Trade Agreement between the Government of the Republic of Korea and the Government of the Republic of Chile.

Maximum Length Of Stay

You are allowed to stay for up to 2 years.

Change or Addition of Workplace

D-7 visa holders are not subject to the report of ‘Change/Addition of Workplace, instead they must report ‘Change in Registration Information’.

Documents Required for Change in Registration Information

  • An application form
  • Passport
  • Alien Registration Card
  • Fee
  • A dispatch order (issued by the headquarters office overseas)
  • Documents proving that the companies are affiliated with the same company (i.e. certified copy of corporate registration)
  • Documents proving the injection of business funds of the additional workplace (i.e. a certificate of purchased foreign currency, lease/rent contract)
  • A certified copy of corporate registration of the additional workplace
  • A copy of business registration certificate of the additional workplace

Change Of Status

Change of status to D-7 visa is allowed for:

  • For German Citizens coming to Korea with Visa Exemption (B-1)
  • For holders of Corporate Investment (D-8) visa
  • For Chilean Citizens with Short-Term Business (C-3-4) visa

Documents required For Change Of Status

  • An application form
  • Passport
  • A standardize photo
  • Fee
  • A proof of employment from the company overseas
  • A dispatch order (issued by the headquarters office)
  • Documents proving the establishment of the branch office in Korea (i.e. a permit for operating the Korean branch office)
  • Documents proving the injection of business funds (i.e. a certificate of purchased foreign currency)
  • Resume or a certificate of working experience
  • A copy of business registration certificate
  • A certificate of annual tax payment

Extension of Stay

General documents

  • An application form
  • Passport
  • Alien Registration Card
  • Fee
  • A proof of employment
  • Documents proving personal tax payment
  • Acceptable documents for proof of residency (i.e. Lease contract, a utility bill payment for any public services)

Additional documents for Extension

  • Business registration certificate of the establishment of the Korean branch/contact office
  • A copy of registration of foreign legal consultant office or foreign legal consultant
  • A copy of permit for the establishment of the Korean branch/contact office (issued by a foreign exchange bank)
  • Documents proving the injection of business funds (i.e. a certificate of purchased foreign currency, lease/rent contract)

Re-entry Permit

Due to the revision of the Enforcement Regulations of Dec. 1, 2010 Korea now Implements Re-entry Permit Exemption. So under the new system, if you are a registered foreigner and plan to return to Korea within 1 year from the departure date, you are exempted from the re-entry permit requirement. In addition, if less than 1 year is left on your visa you are exempted from re-entry permit for the remaining period.

However, if you need the permission due to the entry restrictions, you may submit application to an Immigration (Branch) Office free of charge. You will need:

  • An application form
  • Valid passport
  • Alien Registration Card
  • Fee (single: 30,000 KRW, multiple: 50,000 KRW)

Also please remember that you need to apply for an Alien Registration Card since you plan to stay in Korea for more than 90 days. Apply for the alien card within 90 days of your arrival.
